DESCRIPTION

PLANNING ASPR (Administrative Site Plan Review) with Miami-Dade County Submitted on 3/18. Miscellaneous additional paperwork was filed March 23. Received review comments on April 15. First resubmittal with phase 1 & phase 2 plans was made July 13. Review comments received August 5. Met with County Traffic staff in online meeting on 8/17 to discuss improvements to SW 137 Ave and showing sight triangles correctly on the site plan. Star Transportation executed Landscaping Covenant. Anticipating submitting updated plans to the County by 9/2. Anticipated completion date is approx. mid-September to early October. CIVIL ENGINEERING SFWMD (South Florida Water Management District Environmental Resource Permit (ERP) for drainage and wetland) Application was submitted April 15. Permit application will need to be modified to reflect new phased plan. Resubmittal was made to SFWMD on July 28. Received review comments on August 24. Anticipated completion date for Phase 1 is approx. between October to December. ENVIRONMENTAL DERM review comments to ASPR In their review of the ASPR application DERM is saying they are presuming there is contamination on the property due to its past use as agriculture and therefore they are requiring a Phase 1 and Phase 2 Environmental Site Assessment (ESA). Contamination Screening, Database Review, and SAP are in progress. SAP near completion pending receipt of review by Howard Nelson. Revised Sampling and Analysis Plan (SAP) for submittal to FDEP (still have to evaluate groundwater for DERM’s stormwater discharge standard per M-D County Code). Submitted Sampling and Analysis Plan (SAP) to FDEP & DERM on 8/12. DERM is taking the lead on review/regulatory oversight based on “General” Land Use. DERM review fee paid on Tuesday 8/16. If contamination is found, a Class VI DERM permit will be required for the stormwater management system based on result of assessment relative to planned drainage design. WGI will write and submit to DERM a Class VI Permit Application Support Report based on HWR groundwater assessment data (since it is targeting drainage system design / discharge components) See comment above regarding TBD schedule of field services for sampling. Results will determine if planned drainage design can be approved by DERM or will require modifications. DERM’s approval will still be required by County Code. DERM Class IV Wetland Permit Overall approx. length of process is 12 to 14 months from the time it is submitted. DERM was onsite 12/15/2021 regarding compliance issue in the western portion of the wetland. Permit was submitted on 2/4 for jurisdictional determination. Official permit was submitted April 7. Met with DERM on 6/8. They understand and are onboard with our phased approach. We’ll leave the application in-house but it will only address Phase 2. We won’t need a permit for Phase 1. We will need to scrape the unauthorized fill out of the wetland area to make it match the rest of the wetland grade elevations. This is a smaller area on the west side of the wetland. This will need to be done prior to completion of construction of Phase 1. If it is clean fill, it could likely be used to raise the grade of Phase 1 as needed. Based on discussions about the potential required mitigation for the wetlands, DERM is likely to require around 2.6 credits. We originally proposed 2.25 credits to them. DERM Tree Removal Permit Overall approx. length of process is 2 to 3 months from the time it is submitted. Miami Dade County confirmed that the tree removal permit can be submitted concurrently with the ASPR application, and mitigation will not be required for the remaining trees in the Phase II wetland area, as those are handled under the Wetland permitting process. The Phase I tree removal permit application was submitted on July 29. Received comments back from the reviewer on 8/18. In the process of coordinating with DERM. Once approved, we will need to wait for the building permit to be issued for the tree removal permit to be finalized. Anticipated completion date is approx. mid-September. FDEP (Florida Department of Environmental Protection) Wetland Permit Overall approx. length of process is 12 to 14 months from the time it is submitted. Withdrew permit and will re-submit when we are ready to move forward with phase 2. We are staying 25’ away from the wetland with phase 1 and FDEP is aware of our plan. Met FDEP staff on-site on 3/30. FDEP said that they will not be looking at the whole site for mitigation. They are going to claim the wetland as jurisdictional so we will need the permit. CONTRACTOR Miami-Dade County Building Permit After the ASPR is approved and while the engineering and environmental permits are pending your contractor can apply for a building permit from the County. The County will not issue the building permit until all of the engineering and environmental permits are obtained. RIGHT OF WAY DEDICATION Miami-Dade County sent information and forms relating to the necessary right of way dedication on August 19. . The dedication will have to be completed prior to the County issuing any building permit.
