The Brick Store Building is a Greek Revival commercial building constructed in 1829. The building, which is listed on the Massachusetts Historical Commission’s Historic Register, is located at 1-3-5 Johnson Street, North Andover in the Old Center Historic District. The exterior has been preserved in its original form. The interior of the building was completely rebuilt in 1983 including all new electrical and plumbing. The HVAC was installed in 2010. The building does not have an elevator. 1. The Leased Premises: An Office Suite whose address is 3 Johnson Street on the second floor of the Brick Store Building at the corner of Andover and Johnson Streets in North Andover, Massachusetts. The premises are leased as-is. a. 3 Johnson Street (1,237 square feet) : The suite at the south end, contains a small room, a large room, a private lavatory, and a private stairway entrance from Johnson Street, Common Areas: A common area, shared by the two office suites on the second floor, contains a back hallway opening onto the fire escape, a hallway closet and a shared lavatory. An attic storage area, reached by a pull down stair, which is shared with the Lessor. 2. Rental per year: 3 Johnson St (the suite at the south end): $18,000 per year for the first two years. Thereafter, rent will increase 3%. 3. Heat/Utilities/Maintenance. Lessor shall be responsible for the supply of water for the premises. Lessor shall be responsible for maintenance of the parking lot (including plowing unobstructed areas) and of grass and trees. Lessor is responsible for exterior maintenance and repairs of the building, interior repairs of common areas, and real estate taxes. Lessee is responsible for interior cleaning, electricity, gas, telephone service, Internet service, any other utilities separately metered or identified, replacing their own light bulbs, and an annual service contract on HVAC system. HVAC system was installed in 2010. 4. Intended Use. The intended use is business use only. 5. Term/Renewal. Initial term to be three years with an option to renew for another three year term at a rent to be determined. Notice of intention to renew shall be written and delivered to the office of the Brick store Company at least 90 days before said option is exercised. Rent for the renewal period shall be negotiated between the Lessor and Lessee. 6. Occupancy. At a date to be agreed upon. 7. Parking. The Parking lot is to be shared by all tenants of the building. Each tenant is entitled to space in proportion to the square footage of his unit divided by the square footage of the entire building. 8. Insurance. Lessee is responsible for maintaining a business owner’s policy with general liability insurance coverage and personal property coverage. The general liability insurance coverage shall be at least $2,000,000 with the Lessor named as an additional named insured. Lessee is responsible for providing evidence of such coverage on an annual basis to Lessor. Lessee is responsible for insuring all his own personal property. 9. Renovation. No physical alterations to the building without written permission of the Lessor. Renovations shall be limited to the interior of the building and must be approved in advance in writing. Lessee shall be responsible for bearing all costs of these renovations. Lessee shall be responsible for obtaining all permits necessary for such renovations. 10. Signage: Signs may be placed over the door to the unit Lessee will pay for new signs on the ends of the building and over the entrance. New signs must have approval in advance from Lessor, Old center Historic District Commission, and the Town of North Andover. 11. Assignment/sublease. Lessee shall have the right to assign or sublet the premises to any entity for an intended use as an office with the Lessor’s consent and approval, which shall not be unreasonably withheld or delayed.
