DESCRIPTION

The following summary and attached exhibits will provide you with an introduction to the 132 acres on South Hutchinson Island with over 930 feet on the ocean currently known as “Hutchinson Sands”, which is environmentally fully permitted, and site work could commence very shortly. The property is zoned S-HIRDN (in the North area of the South Hutchinson Island Residential District) which has a land use of R/U which allows 5 units/acre for residential or hotel use. Height is limited to 35 feet above base flood + breaking wave height which is approximately 16 feet on land that is 7 or 8 feet, so there is non-habitable (parking) space under the upper floors, however the Board of Adjustment has added 20% to the height resulting in 42 feet allowed. The land area east of A1A is 28.67 acres allowing a theoretical density of 143 units, but any plan will be governed and constrained by parking requirements for the proposed use as the actual upland area is approximately 5.65 acres. Currently approved development plans are for 92 units with a gross residential permitted area of 231,360 square feet in 4 buildings of 4 floors over parking, a 1,000 square foot recreation building adjacent to the pool, and a private access road from A1A to the ocean uplands. Clearly, any use permitted by the Land Development Code could be considered and a revised application submitted to the County. The 104+/- acres of lands lying west of SR-A1A will be conveyed to the County for preservation and passive recreation and will offer unobstructed views from the upper floors to the Inland Waterway and beyond. This conveyance satisfies the site mitigation requirements so no contribution to the local mitigation bank is required. All lands east of A1A that are not actually part of the developed area will also be under conservation easement to be maintained by the landowner or the unit owner's association which includes both the wetlands and dune area. The property is located 4.5 miles south of the Fort Pierce Inlet and 17.0 miles north of the St. Lucie (Stuart) Inlet. Immediately to the north is a 10-lot single family subdivision with two completed homes. North of that subdivision are 2 County Parks stretching for 2.0 miles to the Fort Pierce City Limits. To the south are 2 other parcels in various stages of permitting. The immediately adjacent property to the south was approved in 2019 for a “Betty Ford” type clinic, but it now appears certain that it will not be built. South of that property “Sunset Beach” with 1,800 feet of frontage is approved for 42 single family lots, each with 40 feet of frontage on the ocean. South of Sunset Beach there are a few private owners, then “WaterSong”, another 40-foot wide lot development dating from 2000 with 3,000 feet of frontage, and a total of 100 lots of which 60 have direct frontage on the ocean. Over-all there are 5 miles of protected beaches on the north end of Hutchinson Island, and 7 miles of protected river front. Due to the extreme lack of available ocean front developable sites within 100 miles, activity and demand here is expected to grow rapidly, especially for permitted sites that can be utilized immediately without spending years to get the necessary entitlements. PERMITTING SUMMARY All site environmental permitting has been completed. The current status outlined below makes this property unique on the Island in terms of current approvals for site development: 1. United States Army Corps of Engineers (“USACOE”): Permit SAJ-2003-05374 (SP-LCK) has an expiration date of August 28, 2023. Permit to allow wetland impacts. This permit includes provision for a filled causeway to cross the mangrove wetlands from A1A to the ocean uplands. All recent approvals have required a bridge structure to reduce wetland impacts which would add over $1,000,000 to the development costs. 2. Florida Department of Environmental Protection/Division of Water Resource Management (formerly Bureau of Beaches and Coastal Systems) (“FDEP/CCCL”): Permit SL-317 issued May 31, 2016 with an expiration date of May 30, 2019 has been extended to May 31,2022. Permit to allow installation of site infrastructure east of the Coastal Construction Control Line. The beach here has been remarkably stable with significant accretion and dune enhancement occurring naturally for the last 10 years. 3. Florida Department of Environmental Protection/Environmental Resource Permit (“FDEP/ERP”), Permit Number EI-56-0267168-002 issued July 15, 2017. Pursuant to extension policy per FS 252.363(1)(a) an expiration date of July 14, 2022 has been extended to October 17, 2025. Permit to allow development in wetland areas. 4. St. Lucie County (“SLC”): Major Site Plan Approval by Resolution 08-017 has been extended to November 29, 2024. a. St. Lucie County (“SLC”): Staff Approval of Minor Adjustment to a Major Site Plan per PDS ORDER 16-031 dated June 30, 2016. Adjustment to conform to increased density from 84 to 92 units, approve 25-foot setback from CCCL, and minor building footprint adjustment. b. St. Lucie County Board of Adjustment (“SLC/BoA”) Approval granted February 24, 2016 to increase building height from 35 feet (3 floors over parking) to 42 feet (4 floors over parking). No expiration as long as site plan is valid. UTILITY AVAILABILITY Both water and sewer are available in front of the property on A1A. The current owner has reserved 75 EDU’s of capacity for both the sewer treatment and transmission line, and as a non-ad valorum addition to the real estate tax the original debt of $335,000 has been reduced to $0.00. An additional 5 EDUs of sewer capacity have been paid in full. Sewer Treatment EDUs are $1,898 and there is ample capacity for any additional connections needed. There is no charge for the IQ water.
