DESCRIPTION
Property History The original parcel* was approximately 60 acres per Canyon County Plat Maps and the attached deed with Instrument #440107. In 1995, the original parcel was divided via deed without Canyon County’s approval into three (3) parcels: one (1) 39.60-acre parcel (R37155011 – Tax Record 95549), one (1) 10.87-acre parcel (R37155- Tax Record 95578), and one (1) parcel with 6.00-acres (R37155010). In 2006, Parcels R37155010 and R37155011 were approved to be rezoned from “A” (Agricultural) to “R-R” (Rural Residential). In 2007, a preliminary plat (Galena Ridge Subdivision) was approved on parcels R37155010 and R37155011 (SD2007-47). In accordance with Canyon County’s Zoning Ordinance at the time (and currently), a final plat application was not submitted and accepted by DSD within two (2) years of the date of written approval of the preliminary plat, so the project has since been deemed abandoned and the preliminary plat has expired. Building Permits/Division Options for R37155011 and R37155010 To obtain building permits on Parcels R37155011 and R37155010 and recognize Parcel R37155’s configuration, the parcels would have to go through the after-the-fact administrative land division process to recognize these divisions that occurred without Canyon County’s approval. Due to parcels’ rural residential zoning, one (1) additional parcel with a residential building permit could be created from R37155011 or R37155010 through the administrative land division process as well (CCZO §07-18- 13). Attached is the administrative land division application with submittal requirements and associated fees. If the property owner desires to divide R37155011 and R37155010 into more than one (1) parcel, then the property owner would need to go through the subdivision platting process. The average minimum lot size for Rural-Residential (RR) zoning is 2-acres. Attached are the preliminary plat and final plat applications with submittal requirements and application fees. Parcel R37155 is not eligible for further divisions without approval of a rezone/conditional rezone and comprehensive plan amendment to a residential zoning district. Secondary Residences If Parcels R37155011 and R37155010 are brought into compliance via the after-the-fact administrative land division process, then R37155, R37155011, and R37155010 may each be eligible for a secondary residence if it is found to be in compliance with Canyon County Zoning Code at the time of application.
