DESCRIPTION

Located in California, this 217-acre Property, which is vacant land, is comprised of three (3) parcels of which two (2) contiguous parcels total 178 acres (APN No.: 037-160-40 consisting of 118 acres and APN No.: 037-160-41 consisting of 60 acres); with the third remaining parcel consisting of 39 acres (APN No.: 037-160-38); which is separated from the other two (2) parcels by the Los Angeles Department of Water and Power electricity transmission line (APN No.: 037-160-39), which is also known as the ‘Pacific DC Intertie’. Renewable Energy Use Information: The Property, offered here has a significant opportunity for the right buyer, owner, or developer of a solar farm and related uses. Inyo County, in 2015, enacted and finalized their Renewable Energy General Plan Amendment (“REGPA”)(which is included with this Listing) and it is administered by the Inyo County Planning Department and the various Solar Energy Development Areas (“SEDA”). The REGPA and SEDA give guidance and regulation for the growth and management of solar energy projects/developments and the attendant land management issues they represent and Inyo County may consider utility-scale and commercial-scale renewable energy solar facilities within any zoning district, under Title 18 of the Inyo County Code, and Title 21 of the Inyo County Code. This Property is located in the "Pearsonville" solar energy development area ('SEDA') and the Inyo County Planning Department has confirmed this solar power farm use is permitted on this Property; as well as other permitted uses outlined herein. The State of California has been leading the way to meet its goal of 100% Clean/Renewable electricity with 12 new gigawatts of Solar energy by 2030 along with California’s push for further alternative/clean/renewable energy solutions, growth, and innovation. The federal government has also, in recent years, passed significant legislation and accelerated the growth, development, and funding of clean/alternative energy significantly with the federal government leading this surge toward clean/renewable energy resources, including solar energy, with new legislation and funding, including the following laws: Clean Energy Innovation and Deployment Act of 2020, H.R.7516 (116th Congress), which was signed into law in July 2020, provides significant federal investment in zero and low-carbon solutions to meet energy and climate goals proposed by the federal government, including over $35 Billion in authorizations for technology research, development, and demonstration; updating and retooling of federal energy programs; energy tax credit extensions; and other clean/renewable energy projects and development. The Infrastructure Investment and Jobs Act, H.R. 3684 (117th Congress), which was signed into law in November 2021, provides up to $73 Billion for Clean/Renewable energy development and delivery of Clean/Renewable energy transmission and grid infrastructure, the building of miles of new resilient transmission lines while expanding renewable and clean energy with new programs and funding to deploy clean/renewable energy technologies to meet the federal government’s zero-emissions goals. The Inflation Reduction Act 2022, H.R. 5376 (117th Congress), which was signed into law in August 2022, lowers energy costs, increases cleaner production, and reduces carbon emissions by roughly 40 percent by 2030 and has over $360 Billion of funding allocated for energy security and climate change, including renewable energy projects and development. And up to $40 Billion in Innovative Clean Energy loan guarantees and subsidies, with an additional $250 Billion in loaning authority for energy infrastructure reinvestments. Cannabis and Hemp Use Information: The Property is also zoned for Cannabis and Hemp Cultivation, Commercial Cannabis Cultivation, Cannabis Manufacturing, and Cannabis Micro-Business Operations which is subject to state, county, and local jurisdictions. Pursuant to the Inyo County government regulations, laws, and ordinances, where the Property is located, Inyo County Cannabis Ordinance 1221 (which is provided with this Listing), cannabis cultivation is legal in Inyo County pursuant to compliance with all relevant state and local laws, including the Inyo County Code Chapters 5.40 (Commercial Business License Requirements) and 3.50 (Cannabis Taxation Requirements). The Inyo County Cannabis Code requires companies, wanting to cultivate cannabis in Inyo County, to obtain conditional use permits for commercial cannabis cultivation in open space zones (where the Property is located), residential, heavy industrial and extractive, and light industrial zones. Cannabis cultivation sites are required to have a minimum 600-foot buffer from a park, library, or additional locations as required. Inyo County also has noise, odor, and visual resource mitigation requirements. Per Section 18.12.040 of the Inyo County cannabis code, commercial cannabis cultivation in open space zones (where the Property is located) must be 300 feet from all parcel lot lines and other otherwise applicable requirements. In compliance with Inyo County Ordinance 1221, cannabis manufacturing is legal in Inyo County. Pursuant to Section 18.06.182 of the county code, Inyo County permits Level 1 cannabis manufacturing for sites that manufacture cannabis products using nonvolatile solvents. Level 2 manufacturing is also allowed for sites manufacturing cannabis products using volatile solvents. Pursuant to the Inyo County Cannabis Zoning Chart (which is provided with this Listing), cannabis manufacturing using the nonvolatile extraction method is permitted in open space zones and on the Property. Cannabis manufacturing using the volatile extraction method is permitted only in the general industrial and extractive zone. Non-mechanized cannabis manufacturing may be conducted in the general commercial and retail zone and the light industrial zone. In accordance with the zoning chart, cannabis manufacturing using mechanized methods can only be performed in the light industrial and general industrial, and extractive zones. In recent years, the California cannabis/legal marijuana industry is experiencing significant growth. More than a dozen California cities have been opening new recreational cannabis licensing opportunities since 2022, by welcoming the legal marijuana industry for the first time or by increasing the number of available business permits for those businesses. Other municipalities and cities are preparing for new cannabis/hemp markets by proposing, drafting, and developing cannabis ordinances. The growth of future cannabis manufacturing and retail markets and business opportunities is welcome news for local economies across California which are looking for new tax revenue; especially after the Covid-19 pandemic, the attendant economic downturn, and impacts on the state’s and local municipalities’ fiscal well-being.
